Terms and Conditions
Effective Date: 6 July 2026
These Terms and Conditions apply to all quotations, contracts and work carried out by K&M Treecare and Landscaping (“the Company”). By accepting our quotation, paying a deposit or instructing us to commence work, you agree to be bound by these Terms and Conditions.

1. Quotations
1.1 All quotations are valid for 30 days unless otherwise stated.
1.2 Quotations are based upon a visual inspection of the site and the information available at the time of quoting.
1.3 Hidden defects, underground obstructions, tree decay, buried foundations, drainage issues, root systems or unforeseen site conditions discovered after work has commenced may require additional labour, machinery or materials. Any additional work will be discussed with the customer before being carried out and charged accordingly.
1.4 Quotations are based upon current labour, fuel and material costs. Where work is delayed by more than 60 days through no fault of the Company, we reserve the right to amend the quotation to reflect increased operating costs.
1.5 Any alterations to the agreed scope of work requested after acceptance may result in additional charges.

2. Acceptance
Acceptance of a quotation by email, text message, written acceptance, signed acceptance, verbal instruction or payment of a deposit constitutes acceptance of these Terms and Conditions.

3. Deposits
3.1 Landscaping and larger projects may require a deposit before work begins.
3.2 Materials will normally not be ordered until the deposit has cleared.
3.3 Deposits are non-refundable once materials have been specifically purchased for the customer’s project, except where cancellation rights apply under consumer law.

4. Payment
4.1 Unless otherwise agreed in writing, payment is due on the date of invoice.
4.2 Larger projects may be invoiced in agreed stages.
4.3 The Company reserves the right to suspend work where stage payments become overdue.
4.4 Late payments may incur statutory interest and debt recovery costs where permitted by law.
4.5 Payment must be made in full without deduction or set-off unless agreed in writing.

5. Retention of Title
All materials supplied by K&M Treecare and Landscaping remain the property of the Company until payment has been received in full.
Where legally permitted, the Company reserves the right to recover unpaid materials if invoices remain outstanding.

6. Access
The customer agrees to provide safe, suitable and unrestricted access to the working area.
If access is delayed, restricted or prevented, additional charges may apply.

7. Underground Services
Customers are responsible for informing the Company of any known underground utilities including gas, electricity, water, drainage, irrigation systems, telecommunications and private services.
The Company cannot accept responsibility for damage to underground services that have not been disclosed or accurately marked.

8. Tree Work
8.1 All tree work is carried out in accordance with current industry best practice.
8.2 Trees are living organisms and cannot be guaranteed against future decline, disease, storm damage or natural failure.
8.3 Internal decay, cavities, fungal infections and structural defects are not always visible during inspection. The Company cannot be held responsible for hidden defects that become apparent only after work has commenced.
8.4 The customer is responsible for ensuring that any required Tree Preservation Order (TPO) consent or Conservation Area notification has been obtained unless the Company has agreed in writing to obtain permission on their behalf.

9. Waste Removal
Unless otherwise stated:
* All green waste generated during the works will be removed.
* Logs, timber and woodchip remain the property of the Company unless otherwise agreed before work commences.
* Woodchip or logs may be left on site if requested by the customer and agreed by the Company. This may incur amendment to the quotation.

10. Landscaping Materials
Natural materials including timber, stone, paving, gravel, turf and topsoil vary in colour, grain, texture and appearance.
Such natural variation does not constitute a defect.

11. Weather
Work may be postponed where weather conditions make it unsafe or unsuitable.
Completion dates are estimates only and may change due to adverse weather.

12. Delays
The Company shall not be liable for delays resulting from:
* adverse weather;
* supplier shortages;
* utility companies;
* customer delays;
* restricted access;
* unforeseen ground conditions;
* events beyond the Company’s reasonable control.

13. Customer Responsibilities
The customer agrees to:
* provide safe access to the site;
* remove vehicles and valuables from working areas;
* keep children and pets away from active work sites;
* disclose any known hazards;
* obtain neighbour permission where access across neighbouring land is required.

14. Damage
Whilst every reasonable care will be taken, certain works involving heavy machinery, excavators, stump grinders or tree removal may cause unavoidable disturbance to lawns, flower beds or surrounding ground.
Minor reinstatement is included only where specifically stated in the quotation.

15. Photography
The Company may take photographs before, during and after works for quality assurance, insurance purposes and marketing, including use on our website and social media.
No customer names, addresses or identifying personal information will be published without permission.
Customers may opt out by notifying the Company in writing before work commences.

16. Cancellation
Customers cancelling after accepting a quotation may be liable for:
* materials already purchased;
* plant hire charges;
* disposal fees;
* administration costs;
* labour already undertaken.
Any refund due will be calculated after deduction of these costs.

17. Complaints
17.1 Any concerns regarding completed work should be raised within seven days of completion.
17.2 The Company must be given a reasonable opportunity to inspect and rectify any genuine workmanship issues before another contractor is instructed.
17.3 If another contractor is instructed to alter or rectify the Company’s work without first giving the Company the opportunity to inspect and remedy the issue, any agreement for remedial work may become void.

18. Insurance
The Company maintains appropriate Public Liability Insurance.
Proof of insurance is available upon request.

19. Right to Suspend or Stop Work
19.1 The Company reserves the right to suspend or cease work immediately where:
* payment is overdue;
* agreed stage payments have not been made;
* the working environment becomes unsafe;
* abusive, threatening, aggressive or intimidating behaviour is directed towards our employees, subcontractors or representatives;
* the customer instructs work that the Company reasonably believes would be unsafe, unlawful or contrary to industry best practice.
19.2 Where work is suspended or terminated for any of the above reasons, the customer shall remain liable for:
* all work completed to the date of suspension;
* materials purchased or specially ordered;
* plant hire and equipment costs;
* waste disposal costs;
* any reasonable costs incurred because of the suspension or termination.
19.3 The Company shall not be liable for delays or additional costs resulting from exercising its rights under this clause.
19.4 Work will only resume once the issue giving rise to the suspension has been resolved to the Company’s reasonable satisfaction.

20. Limitation of Liability
The Company’s total liability shall not exceed the value of the contract for the work undertaken.
Nothing within these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any liability that cannot legally be excluded under the laws of England and Wales.

21. Governing Law
These Terms and Conditions shall be governed by the laws of England and Wales.
Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
